📝 COMPLAINT UNDER SECTION 31 OF RERA

The Complainant respectfully submits as under:


1. Particulars of the Project

  • The Respondent is the promoter/developer of the real estate project titled ____, situated at ____.
  • The project is registered under RERA with Registration No. __.

2. Facts of the Case

  1. That the Complainant booked a residential unit bearing No. , Tower , Floor _, in the above project on date.
  2. That the total consideration amount for the said unit is _, as per the Allotment Letter/Builder-Buyer Agreement dated .
  3. That the Complainant has duly paid _ till date, which constitutes _% of the total sale consideration.
  4. That as per Clause of the Agreement, the Respondent was obligated to hand over possession of the unit by _, with a grace period of _ months, i.e., latest by _.
  5. That despite lapse of the committed timeline, the Respondent has failed to complete the project and has not handed over possession.
  6. That repeated requests and emails dated __ were sent by the Complainant, but the Respondent has neither responded nor taken corrective steps.
  7. That the Respondent continues to demand money illegally without achieving construction milestones.
  8. That the delay is not due to any force majeure event; rather, it is due to the Respondent’s own negligence, mismanagement, and diversion of funds.
  9. That the Complainant is suffering financial hardship due to ongoing EMI/rent and loss of opportunity.

3. Grounds for Relief

The complaint is being filed on the following legal grounds:

A. Violation of Section 11 of RERA

The Respondent has failed to fulfill obligations regarding timelines, disclosures, and adherence to sanctioned plans.

B. Violation of Section 12 – Misleading Advertisement

The Respondent made false representations about delivery timelines, amenities, and approvals.

C. Violation of Section 14 – Adherence to Plans

Changes have been made without consent of the Complainant/Allottees.

D. Section 18 – Delay in Possession / Refund

The Complainant is entitled to refund with interest OR possession with interest for delay.

E. Section 19 – Rights of Allottees

The Respondent has violated allottee rights of timely possession, stage-wise updates, and lawful demands.

F. Section 31 – Right to File Complaint

The present complaint is maintainable before this Hon’ble Authority.


4. Reliefs Sought

In view of the above, the Complainant respectfully prays for the following reliefs:

  1. Refund of the entire amount of ₹__ paid by the Complainant along with interest @ RERA-prescribed rate from the date of each payment till actual refund.
    OR
    Handing over of possession of the unit along with interest for each month of delay from the promised date.
  2. Compensation under Sections 71 & 72 for mental agony, harassment, and financial loss suffered by the Complainant.
  3. Penalty on the Promoter for violation of RERA provisions as per Section 61 and other applicable provisions.
  4. Direction to the Respondent to complete the project as per sanctioned plans and hand over possession immediately.
  5. Any other order/direction that this Hon’ble Authority may deem fit in the interest of justice.

5. Interim Relief (Optional)

Pending final disposal of the complaint, the Complainant prays for interim directions:

  • To restrain the Respondent from cancellation of allotment,
  • To restrain any coercive demand,
  • To restrain execution of any further agreement adverse to the Complainant’s rights.
